In general, post-marital agreements, or Marital Settlements, define the terms of divorce, and any relationship maintained by the two spouses once litigation proceedings have met a conclusion. These types of agreements are formed after marriage or prior to a divorce.

Prenuptial Agreements, or “prenups” as they’re often called, are written documents which dictate how property and assets must be divided in the event of a divorce. Considering that half of all marriages end in divorce, prenups have become popular under the pretext that if the marriage works out, the prenup is irrelevant.
